ATF chief out over botched Mexican arms sting

The Obama administration on Tuesday removed or reassigned the top officials involved in a widely criticized U.S. operation to trace the flow of illegal guns into Mexico.

"Fast and Furious" was intended to gather information on how Mexican drug cartels use operatives in the U.S. to buy and smuggle guns across the border. Federal Alcohol, Tobacco and Firearms agents were instructed to watch ? but not to stop ? the illegal sales in the hope of gathering intelligence on how the smugglers worked.? But in the process, hundreds of guns wound up in the hands of Mexican drug gangs. Two of the weapons turned up at the scene where a U.S. Border Patrol agent was killed in a shootout.

The acting director of ATF, Kenneth Melson, has been reassigned to a Justice Department policy office. And Dennis Burke, the U.S. attorney in Arizona who approved the "Fast and Furious" operation, resigned Tuesday.? A senior Justice Department official said Attorney General Eric Holder had lost confidence in them and that ATF needed "a fresh start."

Melson has been under fire and has admitted mistakes in the sting operation meant to try to crack down on the flow of weapons to violent drug gangs.

Burke is an experienced federal prosecutor. He was also a chief of staff to Janet Napolitano when she was governor of Arizona. Napolitano is now homeland security secretary.

"My long tenure in public service has been intensely gratifying. It has also been intensely demanding. For me, it is the right time to move on to pursue other aspects of my career and my life and allow the office to move ahead," Burke said Tuesday in a memo to his staff.

In a related change, the line prosecutor in the U.S. Attorney's Office in Phoenix who worked on the Fast and Furious investigation, Emory Hurley, was reassigned from criminal cases to civil case work, according to an administration official.

At ATF, Melson will be replaced by Todd Jones, the U.S. Attorney from Minnesota, who will now do both jobs ? continuing as U.S. attorney while running ATF. The Bush administration did something similar, appointing the U.S. Attorney from Boston to run ATF and continue as a prosecutor.

"Fast and Furious," has spawned congressional and internal Justice Department probes and put the Obama administration on the defensive about whether dangerous weapons were knowingly allowed to cross the border.

Vanishing arms
Republicans in Congress have been demanding the Obama administration explain who knew what and when about the ATF program, which was conceived of and run out of the agency's Phoenix division.

Authorities had hoped they would be able to follow the guns to cartel leaders, but ATF agents did not track the weapons after they were transferred from the initial buyer to others. Some agents have said they were not allowed to continue the pursuit.

Instead, numerous weapons from the operation, which began in late 2009 and ran through 2010, have shown up at crime scenes in Mexico and the United States.

ATF intelligence analyst Lorren Leadmon testified before Congress that of more than 2,000 weapons linked to the operation, some 1,400 have not been recovered.

U.S. Border Patrol agent Brian Terry died in a December 2010 shootout on the American side of the border and two guns found there have been traced to the sting. It is not yet known if those guns were used to fire the fatal shots.

Terry's slaying effectively ended the operation.

Mexican authorities have complained bitterly about the thousands of guns that cross the border from the United States each year and want Washington to do more to stem the flow.

Melson took the unusual step of being interviewed on the July 4 holiday by congressional investigators. During those discussions he acknowledged mistakes had been made and other law enforcement agencies had had critical information that they did not share about their targets.

House Oversight and Government Reform Committee Chairman Darrell Issa, R-Calif., said the personnel changes announced Tuesday were warranted.

"While the reckless disregard for safety that took place in Operation Fast and Furious certainly merits changes within the Department of Justice, the Oversight and Government Reform Committee will continue its investigation to ensure that blame isn't offloaded on just a few individuals for a matter that involved much higher levels of the Justice Department," Issa said in a statement.

"There are still many questions to be answered about what happened in Operation Fast and Furious and who else bears responsibility, but these changes are warranted and offer an opportunity for the Justice Department to explain the role other officials and offices played in the infamous efforts to allow weapons to flow to Mexican drug cartels."

Sen. Charles Grassley, R-Iowa, whose investigation brought problems with Operation Fast and Furious to light, called for a full accounting from the Justice Department as to "who knew what and when, so we can be sure that this ill-advised strategy never happens again."

Jones will continue to serve as U.S. attorney when he assumes the top ATF spot on Wednesday.

In an interview, Jones said that ATF personnel "have been hugely distracted in some parts of the country with other things" and that he plans to listen to people within the agency, then "we'll get everybody refocused, to the extent they are not focused."

IRENE WEAKENS | Weekly World News

ATLANTIC CITY ? Hurricane Irene is weakening and may not be the ?apocalypse? that authorities in multiple states are making it out to be.

The worst storm in the history of the world?

Armageddon?? The apocalypse?

Once in a lifetime storm?

Well, looks like Irene was just teasing us.? Yes, it is a major storm, but ?Armageddon? ? probably not.

Dr. Simon Atkins, CEO, of? Advaned Forecasting Corporation as the hype over Hurricane Irene is overblown.? He predicts that ?North of Delaware, most hurricane force winds will very likely be gusts, not sustained winds.?

Atkins goes on to say that, ?The demise of Irene has already begun. There is no visible eye. The storm intensity is down to 99 mph. This would be a low-end category 2 or a strong category 1 storm, while 36 hours ago some predicted a catastrophic category 4 storm. Air Force Reserve aircraft have found that Irene?s eyewall has collapsed, and the central pressure has risen ? rising pressure means a weakening storm.?

But that?s not stopping Mayor Bloomberg from putting the fear of God into New Yorkers:

?Do not be fooled by the sun outside?that is the calm before the storm,? Mr. Bloomberg warned during a televised news conference from City Hall Friday afternoon. ?You can?t wait until there are gale force winds and driving rains arrive. It will be too late then. You have to start your preparations to leave right now.?

Many New Yorkers were ignoring his warnings.? This woman on Coney Island Beach didn?t seem worried:

He issued mandatory evacuations for all New Yorkers in Zone A.?? He shut buses, trains and subways.? Governor Cuomo said he would shut down the George Washington Bridge and the Tappan Zee Bridge, if winds get over 60 mph.? Basically, the Mayor and Governor were telling New Yorkers to? ?get out!!?

Chris Christie, the Governor of New Jersey, was blowing a lot of wind himself.? ?I want everybody off the beaches.? If you stay on the beaches, I?m personally gonna come over and beat your a**.?
Dr. Atkins told WWN.? ?The reduction in storm intensity likely confirms that this storm is not going to be as monstrous as it has been publicly forecast to be. Yes, it will be windy. However, north of Delaware most hurricane force winds will very likely be gusts, not sustained winds.?

Advanced Forecasting Corporation, modeled the following predictions:

1)?? ?There will be wind damage over eastern-most North Carolina as well as some storm surge flooding up the Pamlico Sound. Some houses in the Hamptons will be flooded and destroyed. Flooding might occur in New York?s Battery Park Subway station and on the FDR Drive since the city could get up to 8 inches of rain. There may be some New England neighborhoods submerged due to rivers overflowing.

2)?? ?With 90% confidence, we predict a total damage bill below $1 billion. Unless there is an unexpected secondary or tertiary event, this is not going to be a huge-loss storm.

Pandora Media revenue beats on strong ad sales (Reuters)

NEW YORK (Reuters) ? Online radio service Pandora Media reported that revenue rose 117 percent on strong advertising sales in its fiscal second quarter, beating estimates.

Shares of Pandora rose 5.9 percent to $13.20 in after-hours trade following the earnings report on Thursday.

The Internet company had a closely watched IPO in June that surged out of the gate in its early debut only to reverse course as doubts increased about whether it would ever turn a profit.

Pandora reported quarterly revenue of $67 million, beating the average analyst estimate of $61.1 million, according to Thomson Reuters I/B/E/S.

It reported a quarterly loss of 4 cents per share compared with a loss of 4 cents per share in the prior quarter.

Pandora, which has been around for a decade, runs a mostly free service that allows listeners to create music playlists. It has about 90 million registered users and is mainly supported by advertising revenue.

One major concern for the company is that the more users its attracts, the more it must pay record labels in licensing fees.

Total listener hours increased 125 percent in the quarter.

Pandora shares rose 3.3 pct to close at $12.47 during the regular session on the New York Stock Exchange.

Many homeowners choose to refinance their mortgages with a bank as a matter of convenience. While it?s true that banks are convenient, they?re not going to give you the best deal. Here are several reasons why you should steer clear of your bank when refinancing your mortgage.

The first problem with refinancing with your bank, and it?s a big one, is that banks are exempt from the Real Estate Settlement Procedures Act that requires mortgage lenders to disclose their fees and profit margins. The banking lobby spent millions of dollars to have the law changed and banks routinely take advantage of homeowners using this loophole.

The second problem with refinancing with your bank comes from the way banks mark up their mortgage rates. Banks sell their loans to investors on the secondary market for a profit. Mortgage loans with higher than market interest rates bring premium profits for the bank. Your bank knows the wholesale mortgage rate you would qualify for; however, they mark your rate up to boost their profits. This markup by the bank is called Service Release Premium and if you accept a mortgage that includes it you?ll overpay thousands of dollars for new mortgage.

Service Release Premium is like Yield Spread Premium except for one important difference. Regular mortgage companies are required to disclose their markup, known as Yield Spread Premium by the Real Estate Settlement Procedures Act. Banks as you already know are exempt from this law and are not required to disclose Service Release Premium or their profit margins on your loan. The only one who knows how much they are overcharging you is the bank. Why would even consider refinancing with someone who doesn?t have to play by the rules?

Small Business Profits Are Getting Squeezed | MSPmentor

Some stunningly bad data points are starting to emerge in the small business market. To wit, roughly 40 percent of SMBs have seen their profits decline this year and 31 percent say profits are flat. Translation: Fewer than 30 percent of SMBs are growing their profits from 2010 to 2011. The stats come from the latest Office Depot Small Business Index. I?m an eternal optimist so I?m not ready to press the panic button. But I wonder if it?s time for MSPs to adjust their sales strategies and customer guidance.

Instead of selling your customers the ?dream? of IT as a growth driver, perhaps you should simply accept the economy for what it is: SMBs need to keep their IT networks humming along. But they won?t be hiring full-time IT staffers to keep the lights on. Indeed, 79 percent of SMBs have no plans to hire or add staff. You can fill that void with your virtual CIO services.

In some ways I?m stating the obvious (don?t I always)? But the Office Depot survey really caught my attention. Among the other disappointing stats:

  • only 42 percent of small business owners expect economic improvement over the next six months. This is down from an October 2010 high when 58 percent of small businesses expected economic improvement over the coming six months.
  • 66 percent of the SMBs surveyed indicated that the economic slump has impacted their business, with 37 percent of respondents saying that business has been either ?much worse? or ?a little worse.?
  • In a prepared statement, Neil Austrian, chairman and CEO for Office Depot said small businesses are also worried about inflation, interest rates and qualifying for a bank loan.

Let?s pause right there: I believe interest rates remain at all-time lows. Did I miss something? Has the economy gotten so bad that SMBs now overlook record-low interest rates?

Either way, the survey results depressed me just a bit. The survey was conducted July 13 through July 20, 2011. IT covered more 1,000 small and midsize businesses.

(AP) ? The son and heir apparent of Libyan leader Moammar Gadhafi, Seif al-Islam, resurfaced free and defiant early Tuesday a day after rebels claimed to have captured him, boasting in a bizarre reappearance that his father's loyalists still control parts of Tripoli and would crush the rebellion.

Seif al-Islam's sudden ? even surreal ? arrival at a Tripoli hotel where foreign journalists are staying threw the situation in the capital into confusion. It underlined the potential for Gadhafi, whose whereabouts remain unknown, to lash back even as his grip on power seemed to be slipping fast.

Rebels say they control the large majority of Tripoli, but on Monday they were still fighting pockets of fierce resistance from regime loyalists firing mortars and anti-aircraft guns. Rebel spokesman Mohammed Abdel-Rahman, who was in Tripoli, said the "danger is still there" as long as the elder Gadhafi remains on the run. He warned that pro-Gadhafi brigades are positioned on Tripoli's outskirts and could "be in the middle of the city in half an hour."

The rebel leadership seemed stunned that Seif al-Islam was free. The leadership's spokesman, Sadeq al-Kabir, had no explanation and could only say, "This could be all lies."

He could not confirm whether Seif al-Islam escaped rebel custody, but he did say that another captured Gadhafi son, Mohammed, had escaped the home arrest that rebels had placed him in a day earlier. On Monday, the rebels had said Seif al-Islam was captured, but did not give details on where he was held. The Netherlands-based International Criminal Court ? which indicted Seif al-Islam and his father ? had confirmed his capture.

Seif al-Islam, with a full beard and wearing an olive-green T-shirt and camouflage trousers, turned up early Tuesday morning at the Rixos hotel, where about 30 foreign journalists are staying in Tripoli under the close watch of regime minders.

Riding in a white limousine amid a convoy of armored SUVs, he took reporters on a drive through parts of the city still under the regime's control, saying, "We are going to hit the hottest spots in Tripoli." Associated Press reporters were among the journalists who saw him and went on the tour.

The tour covered mainly the area that was known to still be under the regime's control ? the district around the Rixos hotel and nearby Bab al-Aziziya, Gadhafi's residential compound and military barracks. The tour went through streets full of armed Gadhafi backers, controlled by roadblocks, and into the Gadhafi stronghold neighborhood Bu Slim.

At Bab al-Aziziya, at least a hundred men were waiting in lines for guns being distributed to volunteers to defend the regime. Seif al-Islam shook hands with supporters, beaming and flashing the "V for victory" sign.

"We are here. This is our country. This is our people, and we live here, and we die here," he told AP Television News. "And we are going to win, because the people are with us. That's why were are going to win. Look at them ? look at them, in the streets, everywhere!"

When asked about the ICC's claim that he was arrested by rebels, he told reporters: "The ICC can go to hell," and added "We are going to break the backbone of the rebels."

In Benghazi, the de facto rebel capital hundreds of miles east of Tripoli, the head of the rebel National Transitional Council said the rebels have no idea where Gadhafi is or whether he is even in Tripoli.,

"The real moment of victory is when Gadhafi is captured," Mustafa Abdel-Jalil said. An Obama administration official said the U.S. had no indication that Gadhafi had left Libya.

President Barack Obama said the situation in Libya reached a tipping point in recent days after a five month NATO-led bombing campaign. However, he acknowledged that the situation remained fluid and that elements of the regime remained a threat.

The Obama administration official said the U.S. believes 90 percent of the capital is under rebel control, while regime loyalists still control Sirte and the southern city of Sebha. The official spoke on the condition of anonymity because the official was not authorized to speak publicly.

Gadhafi's forces remained active, firing off a short-range Scud missile Monday near Sirte, Gadhafi's hometown and one of the few remaining cities still under his control, said U.S. military officials, who spoke on condition of anonymity to discuss military operations. It was unclear where the missile landed or if anyone was hurt.

It was only the second Scud missile fired during this year's conflict. On Aug. 15, Libyan government forces launched one near Sirte that landed in the desert outside Brega, injuring no one.

NATO vowed to keep up its air campaign until all pro-Gadhafi forces surrender or return to their barracks. The alliance's warplanes have hit at least 40 targets in and around Tripoli in the past two days ? the highest number on a single geographic location since the bombing started in March, NATO said.

A day after the rebels rode into the city of 2 million, the situation remained volatile. Even though rebels claimed they were in control of most of Tripoli, they still appeared to be on the defensive, ducking for cover during frequent clashes with regime fighters. Stores were shuttered and large areas were lifeless, including the old gold market, in the past a draw for tourists.

Throughout the day, the rebels sent reinforcements to the city from the north, south and southeast, and a rebel field commander said more than 4,000 fighters were part of the final push to bring down the regime. Rebels manned checkpoints on the western approaches to the city Monday, handing out candy to motorists and inquiring about their destinations.

Intense gun battles erupted throughout the day. At Bab al-Aziziya compound, government tanks emerged from the complex and opened fire at rebels trying to get in, according to the rebel spokesman Abdel-Rahman and a neighbor.

Around midday Monday, rebel fighters took over a women's police college near the Mediterranean and declared that they would set up their new headquarters there.

"We are going to protect the city of Tripoli from all attacks and threats," fighter Munir al-Ayan said after kneeling and kissing the ground in the compound.

"I was bowing down to the Almighty God who helped us get rid of this brutal dictator," he later explained.

But the rebels' optimistic mood of the morning quickly changed. By mid-afternoon, the college came under heavy fire. Snipers from nearby high-rises aimed at motorists speeding by. An anti-aircraft gun pounded the compound, creating a deafening noise. A handful of rebel fighters inside seemed jumpy and unsure what to do.

Gadhafi loyalists also launched attacks in two other areas of Tripoli, said Ashraf Hussein, a rebel fighter who sat pressed against an inner wall of the compound for safety.

Drivers trying to evade sniper fire ducked into side streets, or stopped at rebel checkpoints to find out whether the next stretch was safe. Booms of mortar rounds and small rockets reverberated across the city, mixed with battle cries of "God is great."

Later Monday, another battle erupted around a school where rebels and journalists had set up camp. Rebels fired small rockets, and Gadhafi troops responded with mortar shells.

Still, revelers flocked to Green Square, the symbolic heart of the fading Gadhafi regime. They flashed the "V'' for victory sign and motorists circled the plaza, honking horns and waving rebel flags.

"We came out today to feel a bit of freedom," Ashraf Halati, a 30-year-old Tripoli resident, said as he and four of his friends watched several hundred people celebrating at Green Square. "We still don't believe that this is happening."

Late Sunday night, rebels took over Green Square, which they have been calling Martyrs Square, restoring the name it had before Gadhafi's regime took power more than four decades ago. Google's map of Tripoli has already adopted the new name. The opposition also took up the pre-Gadhafi flag of Libya as their own at the start of their uprising six months ago.

The Rixos hotel where foreign journalists are staying also remained under the control of Gadhafi forces, with two trucks loaded with anti-aircraft machine guns and pro-regime fighters and snipers posted behind trees.

About 30 journalists remained in the hotel where armed pro-Gadhafi youths kept a close eye on them and did not allow to them to exit the building. Journalists began to worry that food, water and fuel that powers the hotel's generator were running low.

Some of the journalists attempted to walk out of the hotel but were met with hostility by the armed guards, who said they were put there to "protect" them. Journalists said they felt like they were being held hostage.

Outside of Tripoli, almost all of eastern and western Libya is now under rebel control. The east of the country from the Egyptian border to Benghazi fell into rebel hands at the beginning of the uprising. In the weeks leading up to Sunday's lightning advance on Tripoli, the rebels consolidated control of the western Nafusa mountain range near the border with Tunisia. It was from there they staged the run on the capital. Most of the rest of the country was quickly falling into their hands.

The city of Sirte, Gadhafi's hometown to the east of Tripoli, was the most important loyalist bastion to remain fully under his control.

On Monday, the city was without power and full of heavily guarded Gadhafi checkpoints, said Hassan al-Daroui, an official with the rebel council in Benghazi who was in touch with people there by satellite phone. Many people there were not even aware that rebels had pushed into the capital, 250 miles (400 kilometers) to the northwest, he said.

On Saturday rebels said they gained control of the oil refineries and airport at the oil terminal of Brega, on the road heading out of Benghazi west toward Tripoli.

The rebels' startling breakthrough on Sunday, after a long deadlock in Libya's 6-month-old civil war, was the culmination of a closely coordinated plan by rebels, NATO and anti-Gadhafi residents inside Tripoli, rebel leaders said. Rebel fighters from the west swept over 20 miles (30 kilometers) in a matter of hours, taking town after town and overwhelming a major military base as residents poured out to cheer them. At the same time, Tripoli residents secretly armed by rebels rose up.

Libyan state television was off the air Monday amid reports it had been seized by rebels.

GOP: Still time to find Senate challenger in Pa. (AP)

WASHINGTON ? Pennsylvania Republicans who just last fall were celebrating a slew of congressional and state election triumphs have yet to put up a major challenger against first-term Democrat Sen. Bob Casey.

It's a surprising turn for the GOP in a key swing state hard hit by job losses and in which President Barack Obama's popularity has slipped.

Pennsylvania GOP chairman Rob Gleason tells The Associated Press that there's still plenty of time to find a major challenger against Casey, who won his seat in 2006 by a whopping 18-point margin and is seeking a second term in 2012. He says he's bullish about next year.

Casey has told the AP in a separate interview that he expects a strong challenger and a tough race because Pennsylvania is such a competitive state.
